I would think it is an offence to sell a car without an mot that would not pass one.
But surely it isn't illegal to sell a say,4 year old car without MOT if it is believed to be mechanically sound? Or is it?

Suppose you were selling the car as scrap or for spares.
I wonder what the "no MOT" position would be then?

Selling an unroadworthy vehicle is possibly an ofence even for a private individual. I believe 'operating an unroadworthy vehicle' is a specific offence. I don't think lack of MOT, or even certain failures, necessarily make a car unroadworthy. It's clear that major corrosion, major braking or steering defects, for example, could make a car unroadworthy - because it's actually dangerous. The tester would make that observation. However, most minor defects - the odd failed bulb, worn wipers, even perhaps excessive wear (in the testers opinion) on a steering joint don't come in this category, even though they may be specific offences for which an owner could be prosecuted - if they were really unlucky! For a start, it would be difficult to drive a car home after an MOT failure if the car was automatically unroadworthy.

i put a straight forward answer to a straight forward question and im reading posts about dangerous vehicles,the original poster hasnt got a dangerous vehicle hes got one that cant get an mot because of emmissions. If anybody cares to read the rules and regulations at any car auction (has anybody been to one?) they will see that the purchasers have to make their own decision on whether the vehicle is fit for the road ,the auctioneers job is agent only for the seller( legal thing actually) i have yet to see a seller of a car be taken to court for selling a dangerous car through a car auction but would love to be proved wrong?
With regards a private seller what you do is get a receipt made out spares or repairs must be moved by transporter not driven and get the buyer to sign it when they come to your house.

I wouldn't sell privately or as a p/ex - too much hassle if it has no MoT. Get it to an auction - they its 'buyer beware'. I have seen unroadworthy and smokey cars going through auctions..
