With respect those who also participate in Pepipoo, it seems a bit childish in the fora, so can I have some advice please...

Wife in work a few days ago and gets a call to say number two child, on a day trip with youth club, has been sick for no apparent reason - please collect him from a place 20 miles away. SHe is driving her car, but for a variety of reasons, her car is registered in my name and vice-versa.

So, she goes to collect No. 3 child from creche, who was due to be collected 1/2 hour later anyway and goes to get the poorly boy.

She gets done doing 39 in a 30 on a lightly trafficked road. Do you think if she went to Court, she would get off with a fine if she pleaded mitigation?

I don't understand. Isn't this a fixed penalty notice anyway, rather than a summons? Or do you think that she might escape the points too? Is she facing a ban if she gets another three?

No ban but has three points already - doesn't need more.
Happy (?) to pay £60 but want to avoid points.

Will plea of mitigation work. Clearly did not know how poorly the child was until she got there.

unlikely I would have thought. the points are not going to cause her a ban so the consequences of the points are only financial, insurance cost etc. You might get mitigation if she was going to hit 12 points. Need to be careful that you dont nominate her as driving without due care ?

pepipoo is suffering a bit from trolls, I suspect that if you actually join (pay) and get on to the members only fora things wil be better. It is worth looking through pepipoo to see what the reaction to the pace statement is in the area where she was caught. It does seem that some places dont have a sensible handle on it. Of course you can cause a bit of a fob off by redirecting the nip to her - ie send it back saying that you were not the driver and that she was.

Watch for the method of postage, if not 1st or registered it somehow doesnt count as served ? I never understood that but searching on pepipoo should find a reason.

She qualifies for a Conditional Offer either way, a stop or camera - under 9 points.

She is not obliged to accept the CO and can elect for Court hearing.

There she would have the chance of putting forward any mitigating factors and it would be for the bench to decide.

Personally I doubt what stated would make any impression and may be countered that by speeding she put herself at risk and maybe unable to collect the child if accident occurred. Also could lead to more than 3 points and 60 fine as Court can impose more than the CO.

PePiPoo does seem to be filling up with the idiots who think they're hard done by when they get done for 100 through a town centre so I can understand your reluctance. However, if you read through the past cases, they really have helped a lot of people.

That being said, all the people who've had (arguably) better reasons that Mrs E, have come away payiong a 90 quid fine and 3 points.

I'm sure she wasn't being dangerous but sadly it doesn't work like that anymore. I'd urge her to take the points unless there's a gaping loophole somewhere.

Actually I have just remembered the method I avoided points from my NIP a year ago - but I was sworn to secrecy by the brief who told it me. I can only reveal it by word of mouth and no other way. I should have told you all the NW Meet. When we have the next one I will tell you.

I'd take the points and avoid going to court if it was me. Saying you didn't know how ill the child was probably wont be a good excuse - the counter argument is that whoever was looking after him would have called an ambulance and got her to meet it at the hospital if they thought it was anything serious.

Which force area are you in, Espada? Is there a scheme running where she can avoid the points by going to one of those half day speed awareness courses, if she's really bothered by the points?

If it's any consolation, I had six points up until about a month ago, and when it went up from 3 to 6 it didn't affect my insurance at all.

We're in Manchester and as far as I know there is no scheme to avoid points by going on a speed awareness course.

I have now discovered that she was caught by a mobile video camera at the bottom of a hill in a semi-rural location, so I think a bit unfair, so I shall use my tried and tested method and see what happens.

They have this scheme in the Thames Valley as a pilot - i think Iheard that it was going to be rolled out to other areas as it had been judged a success. SWMBO has gone on one - they were doing it only for people who were caught soing6 mph over the limit. 5 mph or less - OK: 7 + mph - NIP without the option.
