hi,

i've got a problem and need help.

i bought a new model 3 year old vectra from a hyundai dealer a month ago. Straight away there was a problem with a warning light and i also discovered creaks from the suspension and rattles from the back (really loud)

i immediately took it back to get it fixed, it was sourced to the vx dealer nearby to fix them all.

i have had a curtosey car for the past 3 weeks will this has been getting done, i went on thursday to pick it up and the hyundai dealer said it was the warning light that was the problem and why it took so long (new computer ordered)

i drove the car away and the creaking from the front and loud rattle were still there after 3 weeks!

bearing in mind i'm not overly impressed with the car i have decided to take it back and get my money back. but when i went today they said they couldn't accept it as they are fixable problems, they would have to speak to their director.

What are my options here, i didn't know whether to start mention trade descriptions act cos i didn't think it was a bad enough situation.

i don't want to keep the car

i had a month period to get any problems fixed, which i am still in. would that include taking it back?

help me, what are my rights?

Your much better off contacting your local Trading standards office but if you have given them a resonable chance to fix the fault then your entitled to your money back. The goods have to be fit for the purpose and of resonable quality. If they don't refund you, send them a recorded letter stating what you want, why and give them 7 days to respond.

In the meantime, get in touch with trading standards.

so really i have no RIGHT as such to a refund

i think the director's going to simply say no

what about if they again offer to correct the faults (unknown timescale)

I presume they are fixable, but i'd rather get something else.

J1mbo didn't say you have no right to a refund - he made the sensible suggestion that you speak to trading standards and get the knowledge of what the law is. Then when you speak to hyundi again you know where you stand and can get heavy with them.

If no joy then I suggest a weeks rental of a transit, complete with sign 'Before you buy here, ask me about the car they sold me' Park outside, print a hundred or so flyers detailing the problems, lack of response, breech of legislation (if applicable)

I understand this is causing some stress but I did not state you had "no right". You do, but only within the law and the law states you must give them the chance to resolve the faults. I would take it back, see the service manager and state its their last chance to fix it, I would also back it up in writing to the head office to advise them what your doing. If it comes to small claims court, all this will help your case. (which is what you are building).

More than likely the creaking from the front is actually the radiator mounts. It's a known issue that Vauxhall dealers are aware of, or they should be. It's mentioned in HJ's car-by-car breakdown as well. Also I've just had the mounts changed on mine and it's made an already quiet car even quieter.

i did my research before i took it in and told this could be the radiator mounts, also a possible fix for rear creak from pillar.

then when i got the car back it was exactly the same

this is what has sent me over the edge, the only thing i dislike about the car is the gearbox, and these faults

well trading standards weren't much help they just mentioned the sale of goods act and that faults on pre owned cars are normal and whether they were offering to fix them. i said they were supposed to of but didn't

she simply said right a letter saying you are rejecting the car.

i think this is going to be decided my the managing director whether he says yes or no
