So, Take the lead, paws for thought, return the missal with proof of postage, (free) and state your reasons for not biting , that way you can avoid the hounds of justice too.
Gives you something to get your teeth into over the weekend, and not forgetting, their bark is not as bad as their bite, and don't get rabid over it!
Throw them a metaphorical bone to carry away.
Just don't let the baliffs collar you...

make a photocopy of the PCN and send the photocopy back to them with a letter pointing out their error.
|
I would be inclined to do absolutely nothing. If they have cocked up their own so called evidence then it is their problem. Wait and see what transpires. You will get letters with increasing threats; burn the house, shoot the dog, kidnap the kids etc but until you actually get an official letter from the small claims court let them stew. You have a perfect defence in the small claims court because they clearly have no idea which car has caused the so called offence. The courts are no more keen on these low down, blood sucking, money grubbing, pond life companies than we are, so with good evidence you will walk it. Hold your nerve though, do not give in to threats. They have to prove to the court that you actually committed an offence, which they will have some difficulty doing.

I got one in Barking when renewing my Corgi registration but, to be honest, rather than contact Watchdog, I just rolled over and paid it. I'd have got back sooner but my new Hush Puppies were killing me.
Must go, got to collect my loudspeakers from the shop...they've have new sub-woofers installed.
|
Dont contact them and give them a chance to correct their error.
If it escalates to a court, you have the best evidence to spring on them and claim hefty compensation for aggravated harrassment.
|
Thanks everyone for there advice I've used their online appeal form to point out that they have two different vehicle registration numbers so just wait to see what they say but as people have said if it goes to court they won't have a leg to stand on.
|
I got an email from them yesterday apologising for there mistake.still don't think I'll be using the shop where this company run the car park any more.

Corgi? went out with the ark mate, Gas Safe register now. If anyone can make our pooch gas safe I would appreciate it!!
I get the impression that KB is not taking this entirely seriously, his dogged determination to make jokes is impawsable!!!

Sorry, Concrete, you're right. I have a mate from Denmark called Ken staying here and he agreed with you too. He loves the UK having only come over here recently for the first time...he calls it his new found land. He's a super bloke, my mate Ken, a really great Dane - always giving good advice to me....well, not so much advice - just pointers really. If I'm unsure about something I'll always ask Ken becauseI know that Kennel know the answer. For example he reckons you should always closely check the paperwork in parking tickets...make sure there's not an incorrect claws in there. He's a dyslexic atheist and he asked me recently if I believed in Dog. He says never ignore a call of nature. If you need a Shih Tzu then have one....never wait for a Maltipoo (note...I kid you not - there's a dog called a Maltipoo...who'd have believed it?).
OK, early night for me...off to bedlington soon...and I've spent so long chatting with Ken today I've got a bit husky.
Night.

Can't remember the firm but we got a PCN from an Asda supermarket we'd never been to in the wild west mids, thinking i'd caught SWMBO out having a tryst in that well known romanticking spot with a previously unknown fancy man i eagerly logged onto the evidence pic to identify the cad, only to find our Scooby had morphed into a pug 307 with a different number on the plate, presumably their poor admin dept can only afford pound shop spectacles,
We let it got months before putting them out of their misery, quite amusing really.
No fancy man after all.

Mine has been cancelled I think. I wrote to them and they have not written back, checking on their website it now says amount due £0.
A friend was saying the other day, he got a PCN for going into Lidl and leaving 14 mins later without buying anything. Apparently you only get 10mins free parking unless you buy something in that store. It's a wonder people still use these retailers when they show such contempt for their customers.

Quite right too! Lidl and Aldi both have smallish car parks often in good locations, and some people, (not necessarily your friend) use them to pop in somewhere else.
Here in Colchester the Magdalen st shop and stanway road both have limited parking.
Trouble is when parking is free, or at least without penalty, it will be abused.

My father got royally mugged off by a woman in Aldi at Lexden. He let my mother go shopping and he couldn't find a space so parked in a child only bay (not to block the car park) and stayed in the car waiting for another space to be available. Along came a woman and confronted him about it saying he didn't have children and he should move because she had children. After he gave her the space and she parked up, her and her children then disappeared out the car park and went into the Church! (which has it's own car park)

And it will get worse. A vet practise (to continue the doggy theme) is opening soon opposite and naturally has no parking, so where do you think everyone and his pet will park. The church (kingsland) also have the problem of aldi shoppers parking in their car park, but you haven't got a prayer of getting their tickets cancelled...

How can Lidl know whether you bought anything? You don't provide your reg no at the till so they have no record of purchase or no purchase.
Not at the three Lidl's near me, anyway, there are cameras on the car parks which can obviously monitor their 90 minute allowance.
Where is the Lidl that your mate allegedly got a ticket?
|
The parking mob covering Lidl's (and other retailers on that) site at Kettering put a bloke on duty for some of the day watching/photographing, he would watch for anyone actually leaving the parking area on foot, then he would take a pic of their car and the invoice would arrive in due course.
I believe there are signs warning parkers that they must not leave the mini retail park.
There was a heck of a local Faceache hooha about it and i believe parking spy has now been stood down, presumably he's back abseiling onto embassy balconies.

It was in Kent. I can't remember the exact branch but, he went in to get something on the special offers and they didn't have it so they just left. A while later he got the PCN in the post. I have no idea if they ask for reg number at checkout or not.

Even if reg numbers were demanded at checkout, the checkout operator can't scroll through all numbers recorded by cameras and delete those given by purchasers. At Lidl and Aldi, checkout operator performance in terms of number of items scanned per minute is monitored so no way they have the time.
If there is a 'free 10 minutes', who is keeping track?
The only way this would work is to have a man on the exit who has noted arrival time and demands a till receipt from cars leaving more than 10 minutes after. Doesn't seem realistic to me, there may be more to this tale than your friend has told you.

I don't know if this was the store he used, I'll ask him next time I see him (if I remember).

Wackyracer, thanks for the link you posted, ludicrous to leave the identifying of purchasers to the checkout operators, obviously slows the flow and subject to human error and many disputes.
Local Lidl's used o employ a man to patrol the carpark and check time of stay/people parking and leaving on foot to shop in town, but after a few months gave it up as not worth the cost.
|
In Carmarthen, where we used to live, Lidl had a national (pcn) company who had a man with a machine going around during the day, and he was still there when we left after 7 years but was due to retire.(he also cleaned the carpark, cleared a bit instore, acted a a bit of unofficial security (i think) and incidentally took orders for the best freshest eggs from his own farm and was generally a thoroughly nice bloke!

The Lidl at Ashford has 90 minutes free for Lidl shoppers. Sometimes I go in for one item, if they havn't got it I am in there for 2 minutes. I just go to the till and explain, give them my reg number. No problems. Just follow the system.
