xxxx gave us an option to a van in writing. Which we decided to accept and we paid them the £660 Deposit. We were told delivery would be within 14 working days.
After a large number of attempts to get the rest of the relevant paperwork to fill in, the 14 day delivery time came and passed. Once again we were told it would be another 14 days. Two days before the 14 day deadline the paperwork arrived with a totally different price and terms. This meant the initial contract could not be honoured by them.
We were not happy with these new terms and asked for our initial £660 back and they informed us this was not refundable.
Backed into a corner we decided there was nothing we could do so we had to accept the new terms and go ahead.
The only stipulation from us was that they didn’t send the paperwork until the van arrived and was ready to despatch. We were text by a staff member from xxxx to say the van had been delivered and was ready.
Once all of the documents were signed we then started to really struggle. At this point we had had no van for 28 days.
Today we have telephoned the dealer we are receiving the van from directly and they have informed us the van has not yet got to them! Yet another lie and this time in writing from xxxx.
Now we are in to the second month since we initially signed up and STILL no van and now they STILL have not given us any information as to when the van will be delivered.
The main problem we have is that they took the initial deposit of £660 from us with false terms and conditions in the contract which they could not honour. Once they admitted they could not agree to the terms they had initially offered us they then said we could not have our money back. Is that even legal???????
