Yesterday I had a Blue Badge holder in my car but when we got to our destination we were just unable to park and had to give up. Someone then told me that with a Blue Badge holder you could park on double yellows. To me this seems wrong as they are there for a purpose – for safety reasons or to prevent congestion. Saying that on one route I use on a weekly basis there are usually two or three cars (displaying Blue Badges) parked, where there are double yellows on both sides. This often causes congestion. It is also on a bus route and when I was on a bus last year the driver commented “Disabled? Disabled brain more likely!”. So what are the rules on this?

The rule is simple - it must not cause an obstruction - but that also applies to any other vehicles who can stop on double yellows, as well as Blue Badge holders - that is, vehicles loading/unloading unless there are additional loading restrictions including allowing passengers to get in/out.

Double red lines mean no stopping for anyone.

So, if they're causing an obstruction, inform the police - if they aren't causing an obstruction regard lack of mobility as something you may experience yourself in later life, but I don't wish that on anyone.

Your answer is in Section 117 Road Traffic Regulation Act 1984 (google it)

which makes in no offence against Traffic Orders made under RTRA (i.e.lines)

providing a blue badge is displayed.

But as stated the offence of obstruction is made under other Acts so doesn't apply.

Used to be that onlly Police could confiscate the basge if misused but power extended to thos LA's that wish for CEO's to do it.

I must admit I liked the programme i saw a while back where they were filming for tv people abusing the blue badge system, ( Watford i think) and I hate it when roads are obstructed so that buses and trucks are unable to pass.

The Wiltshire one is odd. I can fully understand the second car to arrive being booked, but unless both appeared at the same time the first car was not obstructing until the second one parked opposite it.

But that would need credible witnesses and police time to take statements - simpler all round to slap fixed penalties on both of them even though it's unfair on the first to arrive.

True, but ticket me like that and you'll get a big fight! Because unless someone has a credible witness that you were the second car, or you both arrived and parked together such an action is demonstably unfair. Even then, that only makes it one word against another.

Mind you, I've had a blue badge for over 3 years and I've never parked on a double yellow.

In England and Wales, the Blue Badge clock limit of 3 hours still applies to all highway parking unless it's unrestricted for all road users - some off-road car parks allow extra time for Blue Badge holders but not all do.

In Scotland, the Blue Badge permits unlimited time parking on-road - they don't issue the clock there.

I'm not sure about Northern Ireland.

For clarity, the 2 hour limit for free parking at Motorway services also applies to Blue Badge holders.

And local councils are able to charge for parking in their car parks in disabled bays. Round here the free parking is just for on-road parking.

Our local hospital used to offer free parking for Blue Badge holders. Simply take ticket and badge to the car park office and they would sort.

But a vast number of people were abusing the system so now its the same charge for all.

It was suggeested that the car park office should check if the person named actually had an appointment or was visiting but it was deemed (quite sensibly) it would not be possible to do this.

And now all those who can,t park in the hospital car parks here are parking in the residential streets and so we are shortly to have lots of yellow lines and parking permits at £80 a throw. Including the blue badgers who do park free at the hospital. It,s not fair on the residents.

Residents parking was the best thing to happen to us-being only a five minute walk from a city centre and ten minutes from mainline station-City of London in 35 minutes-train every 12 minutes-our streets were jammed with commuters parking by 07:00.
