Mitsubishi Deliva SpaceGear 2.8 Turbo - No backup from specialist dealer - justabloke

Hi,

I have recently bought a Mitsubishi Delica, now I know its old car 18 years, but the bodywork is in good nick and it runs well. The dealer I bought it from advertises as a specialist in this type and it came with a 12 month MOT with no advisories.

On delivery the speedo and rear fog lamp didnt work, within two weeks I went to get the tracking checked and was told three of the four tyres should have had advisories due to cracking and depending on the tester might have failed whilst a fourth tyre had a puncture repair in the sidewall.

I also complained to the dealer in writing that there is a loud clunking from the front dirveshafts.

Within six weeks of purchase, prepping for a trip, I checked in detail under the vehicle and found four drive shaft boots split and one steering rack boot split.

Now I am having serious doubts about the validity of the MOT, I know its only valid on the day of the test but it doesn't seem reasonable for this many issues within six weeks and under 2000 miles of use. the delaer fixed the fog lamp and has replaced the instrument cluster.

I don't expect new tyres on a used vehcile and have asked the dealer for a contribution to new tyres, he has refused but I have chenaged the tyres for my own piece of mind.

He has also refused to take any responsibility for the driveshaft or steering boots.

I am planning on getting a report from another local import specialist as I beleive the vehicle was mis represented.Depending on the outcome of this inspection I will either take it on the chin as a lesson learned not to trust an MOT or try the small claims court.

Any thoughts.

M

It is 18 years old, so no comeback in law unless dangerous faults.

tyres, put down to experience, and same for gaiters.

if you buy another (!) spend some money having it go through an mot and you might just save some money. if you are paying ask the tetser to be severe and slip him something to give it a checkover for other things.

Caveat Emptor!

My advice to anyone buying an old car is to check everything thoroughly. If you are not competent to do that yourself.. and it takes time and knowledge, get someone else - who is competent - to do it.

Next time, spend some money on a professionla inspection.

Tyres, drive shaft and steering boots should all have been picked up when you or your chosen person examined it before purchase, it sits high off the ground so the most cursory butchers under would have revealed all of this.

Hopefully you've had the boots replaced and the joints cleaned out and repacked with grease, otherwise you're going to be looking for new drive shafts and possibly a new rack shortly.

Seeing as its obviously a completely neglected vehicle it needs a full service including a complete brake strip out, transmission and all other fluids checked etc.

Simple things, suckered by a new MOT and trusting folk.

Fluids & filters have been changed, looked at the trans fluid and thats a nice red colour not looking burnt at all. So pretty happy with that, oil was clean and water reservoir is clean so looking good with the motor side of things. Diffs are next for oil changes with auxiliary belts. Brakes seem fine stops in a straight line with no judder.

As for a "cursory butchers" the boots were either split at the back or on the first crinkle, unless its on full lock you can't see the splits, I know it sits high but I only spotted it on my back under the bus looking for something else. To my dying day I will believe they were split when the MOT was done.

Just getting estimates now to do the boots now, I simply dont have space at home or a big enough jack and stands to do the job safely.

I am annoyed with myself for not checking more rigorously, I had looked at a few and condemned some due to the condition, not buying a rust bucket, This one has a good body for the age, and with an MOT that was only a week old , from a specialist dealer why should I need to check boots and things that are MOT Failures ! The dealer claims to be an expert and according to his advertising refurbishes all cars fixing all faults before putting them up for sale.

If I had bought one from Joe public at the side of the road then yeah, my bad, but I was paying a bit extra for a supposedly expertly prepared vehicle, I mean it had done less than ten miles since the MOT. The fact this had a clean MOT, no advisories only a week before I bought it I do suspect something more than carelessness son my part or bad luck.....

At least its not a crippling amount of cash and I suppose being duped once in over twenty years of buying used cars isnt too bad... :(

Not given up on this one yet. Yes I would buy another I can't think of anything else that does the same job. If I can do without the off road rufty tuftyness then yeah, Previa, Elegrand etc are there to be had. I need somehing bigger than a Galaxy type thing , need to have luggage/dog plus six full size passengers.

Why not complain to VOSA about the tester?

Mitsubishi Deliva SpaceGear 2.8 Turbo - No backup from specialist dealer - Simon

Its an 18 year old vehicle and at least six weeks from when it was MOT'd, you've got very little come back and I can't see VOSA being that interested now.

The splits on the driveshaft gaiters - if they were that hard to spot were they actually split or just perished? I would have thought that a 'proper' split in them would have led to them losing a proportion of grease and that would be obvious from where it should have been spraying out?

It's no use complaining to VOSA after you've already had repairs carried out, I'm afraid. If they are to give serious consideration to a complaint then VOSA need to see the vehicle in exactly the same condition as it was in at the time of testing.

Repairs already carried out - forget it!

Unfortunately, what you have already been told is correct. You've got little to no chance of getting VOSA involved once repairs have already been carried out.

You state that on delivery, the speedo and rear fog lamp weren't working. I assume you test drove the car ? If so, then the non-working speedo would have been obvious. The fog light could be a blown bulb, or a corroded wire, or a fuse.

The car is, as you say, 18 years old. However, you don't say what you paid for it. The price is a rather important piece of information when determining what your 'reasonable expectations' should be. £500, then you basically bought something for scrap value. £3k, a rather different matter.

I think you've got to put this down to experience. Live and learn - particularly that buying an 18 year old car, of any type, means that large numbers of parts will be worn out, and it is one breakdown away from being in a scrapyard. You might be lucky, but you probably won't be.

Being a Japanese import with much lower mileage than equivalent European car of same age Im willing to take a chance, and would do again. Yes I would check better, there were other problems in my life which distratced me at the time.

Moral of story-Concentrate on one thing at a time !

It was marketed by a specilaist dealer as refurbished so was well into four figures. Having had a professional second opinion I'm told apart from the gaiters, tyres and a couple of bushes its a good un. This from an import specilaist who is also an MOT station. My rear concern was chasing rust

My reasons for considering VOSA / local trading standards are more about making sure this is doesnt happen again to others. Over six weeks on the dealer still has by vehicle advertised

I have also found a strong owners club so hopefully it wont be one brreakdown from the scrappers !! There is a strong community to keep these busses on the road.

All the best
