Hi all hope your all having a fine day.

I'm after a bit of advice. I had an accident last night, I was driving down a mountain road ('A' road). I came around a bend to find all bricks in my path, by this time I knew I was going to hit them (which I did). This blew 2 tyres and took me into the part of wall that was still standing. Insurance say it a fault claim and to recover any monies. Is this worth pursuing?

The insurers will, I suspect, argue that you approach bends (especially at night) at a speed which allows you to stop or otherwise avoid unexpected obstructions in the road. This is why they class it as your fault.

Hi there and thanks for the reply. I was consigned to the fact id be to blame from the call to insurers. Would you happen to know if with it being a civil matter against the highways agency, wheather a solicitor would take it up? The agency had already known about it because they turned up 10mins later and police officer hadn't reported anything. The agency said that somebody had already reported something?

Surely the fact that you hit the bricks indicates that you were travelling too fast to stop.

Now I don't have a law degree, or a degree in philosophy, but you'd have to be pretty stupid or stoned, not to see the logic.

In theory in every accident someone is at fault and that person (or their insurers pays the bill).

Your car hit the bricks, damaged 2 tyres and and as a result you hit the wall. Since you were driving and no other party was involved you are to blame, its as black and white as that.

Your only possible salvation would be to find who hit the wall originally knocking the bricks onto the road. Even if you found them it would without doubt be very difficult to get their insurers to cough up for your damage since yours was a totally independant accident that occurred at a different time.

These things can happen, its what we have insurance for. Be thankful no one was injured.
