How long should BMW take to fix an engine management fault on my 320?

I recently booked my car for a service and the engine management light was on. It is a 320 petrol coupe and the three-year warranty expires at the end of this month. They did the oil service and corrected the issue, but the light came back on within a day. I subsequently booked it in for another check which they thought would be routine, but they have had the car since 27 August. At the moment they are telling me they have changed the plugs, coils and injector heads, but it is still throwing up an issue with the emissions which they are unable to identify. The garage is telling me that BMW, Germany is now involved and that they are basically scratching their heads, but of course, they do not want to release the car until it is repaired. However, to complicate things further, we recently had our third child and have bought a people carrier, so my intention is to sell the BMW and keep my wife's old car, so I am currently paying for three cars when I only need two.

As well as the problem of the repayments, the car is depreciating and at present there is no sign as to when I will get the car back, by which time it will need an MOT and be out of warranty. So, do you know what my rights are legally with regard to length of time they can take to fix an issue that is covered under warranty and also, what will happen if the warranty expires and they still haven't fixed it? Lastly, am I entitled to any kind of compensation?

If the fault occurred in the warranty period then it should be fixed under the warranty. There are no specific rules regarding the time in which the repair should be effected but you should make the garage aware of your concerns. You may be entitled to recover your quantifiable losses if you are unable top sell the vehicle but without agreement this might require recourse to the court.
