BMW 2 Series dual mass flywheel failure

I bought a new BMW 2 Series Active Tourer in March 2015. Now, nine months later and 5500 miles, the clutch/dual mass flywheel has failed. The deaker has blamed my driving style. I replied that my wife and I have 100 years driving between us and never burnt a clutch out before.

To date the garage has refunded the cost of parts, but still charged labour and have offered a low figure for trade in and full price only for replacement same spec car but with auto box. What should we do?

First failure we have heard of in this drivetrain either in 2 Series Active Tourers or in MINIs. It is, of course, a new transverse rather than longitudinal drivetrain. As long as the car was fixed at the dealership you bought it from I think you have a case to demand the return of the labour costs as well and would probably succeed in a Small Claims action.
