BMW 1 Series struggles to change gear

My BMW 116i F20 is struggling to get into any gear from neutral when the engine is cold. Once moving changing between gears is fine. The problem seems to disappear once the engine is at operating temperature. The car is four years old with 21,000 miles.

The warranty ended in October 2014. Do you think it would be fair for BMW to contribute/pay for any repairs?

Probably the transmission oil. Get it drained off and replaced.
