Failed automatic transmission on 2004 C-Max - can I sue Ford?

Our 2004 Focus C Max has just had a terminal automatic transmission failure. The local garage (member of Good Garage Scheme) has confirmed it needs a new gearbox, at a cost of £2000-£3000.

Does this model have the "nightmare transmission" that I have read about? I believe that some people have attempted legal action against Ford, do you have any ideas whether this has been successful or not?

Good Garage Scheme is meaningless to us except that the garage buys a range of lubricants to qualify for the name.

The combination of this engine and transmission is notorious because the torque of the engine exceeds the capacity of the transmission, so to have lasted nine years is brilliant. Can't see any success against Ford for a nine year old car. If less than six years old, perhaps. Think hard whether to spend the money repairing or simply cash in the car and replace it.
