Are Shell liable when the fuel pump cut out fails to work?

I was filling my car with diesel and noticed the pump was running very slowly. I was watching the dials on the pump when I heard a splashing noise, to find that the 'full tank' cut off on the pump was not working and diesel was flowing out of my tank onto the floor and my boots.

The boots are ruined and I have contacted Shell to recompense me for the cost of the boots but their insurers are saying that Shell have not breached any of their legal requirements.

They also say that the pump did not show any faults. Where can I go with this? It is worth noting that another pump had also overflowed on that same day and had been taken out of service.

www.moneyclaim.gov.uk You might win. You might lose because Shell might contend that the fault was with your car. Alternatively, if it's a small amount, faced with the threat, they may simply pay up.
