Noisy Polo fuel pump?

We purchased a brand new Volkswagen Polo a few weeks ago. The car has developed a whining noise which you can hear from inside and outside.
We are told that this is a common characteristic of a VW Polo fuel pump and that we have to live with it. I am told that VW Germany have no customer facing technical staff so I cannot speak to the manufacturer's technical department.

I would like to know whether it is true that Polo fuel pumps commonly whine an, what legal rights I have if I do not want to live with a whining car. Many thanks for your help.

You don't say which engine. All engines have fuel tank lifter pumps. Petrol models have an injection pump under the car. With diesels the high pressure pump is on the engine. The usual reason for a whining petrol injection pump is air in the fuel line.
