Clause 56 - does this apply?

What is the position for a driver, identified as such by the registered keeper in response to a parking charge notice enquiry? Is his situation still as it were pre clause 56, ie. ignore the notice and leave it to the parking management to pursue the matter through the courts, or more likely not, or does clause 56 alter this?

Clause 56 does not come into effect until 1st October 2012. After it comes into effect, unless the registered keeper identifies the driver, he will become liable for whatever civil charge is imposed for the alleged breach of contract. But he could still leave it to the courts to decide if there had in fact been a breach and if the penalty is reasonable.
