Excuse me please

I received a letter from Thames Valley Police Fixed Penalty Support Unit on 7th Sept 2011 to notify me that I was doing 36mph in a 30mph restriction on August 17th 2011.

I wrote back to them to suggest that the vehicle in question was a 1979 Suzuki 550GSE and that the profile created by such would not be the same as a car, and the fact that the bike is so old that the calibration of the speedometer might with mechanical wear and tear show a speed that was not correct, thus the grace of speed plus 10% + 2mph = 35mph would put my bike within this tolerance figure.

I received a letter from Bryan C Pritchard, saying it is my responsibility under various motor regulations to ensure that the speedometer is maintained in good working order at all times. He has chosen to miss the thrust of my argument. How can I establish this?

Do I arrange for the speedometer of my bike to be subject to Rolling Road Test. I tax, insure and MOT this 32 year old bike, so surely I have legally discharged my responsibilities. They have offered me the opportunity to pay £60 plus 3points on licence or take a £90+ awareness course. The course in the experience of my friends is not productive but would mean I escape the 3 points and again making the motorist an easy and lucrative target. I would welcome your advice.

Just take the speed awareness course, avoid the points and shut up. Your argument has no legal basis that favours you.
