ESPer rants-on

I have become an unfortunate member of the now infamous ESP light staying on problem with my beloved Golf. My problem started mid August 2010. The ESP light lit on my dashboard and on the switch. No matter what I did, such as turning the engine off and then on again as instructed in the handbook it did not clear. So, I took my car into my usual VW garage and was told that it was and ABS pump failure and that it would need to be replaced. I asked how much it would cost and was told that it would be expensive, but was immediately told by the dealer that I should not worry as VW would cover at least half the cost. Sure enough when I picked up the car the repair cost was shown as half paid by VW. However, my suspicions were raised as to why this had happened in such a young car and why VW offered to pay half so quickly. I therefore began to research this on the web and found numerous articles about this ESP/ABS problem. This lead me to write to VW asking for the full cost of the repair to be refunded to me in line with what they had done for other owners and based on the fact that my car has been owned from new by me, always serviced by a VW garage and only has 35k on the clock. My car has a 55 plate. I have today received a letter from VW Customer Services saying that as my car was out of it's 3 year comprehensive warranty they would not pay a penny more to the repair costs. Please can you advise me on what I can do next, as I feel that VW should be covering this design fault and probably issuing a recall to replace the faulty item for all VW owners.

Feedback now tells ne that VAG has relented slightly and is repairing fully VAG serviced cars up to 4 years old free of charge and up to 6 years old at minimum charge. The EC has legislated that all cars have to have ESP. Yet, not only can ESP kill you by fighting your reactions in a skid (its more likely to save you, but the opposite can happen), ATE Teves Mk 60 ABS/ESP modules have proved to suffer a faulty pressure sensor after 2 - 6 years. So 'safety equipment' that fails and costs car owners fortunes to replace has been legislated into cars. And VOSA, which has ordered Bentley to replace the springs in its winged Bs because they might injure pedestrians, is unwilling to order a full safety recall at the expense of the manufacturer, just as it failed to do over the Meriva electric power steering issue.
