Jazz fuel warning

Our new Jazz (March 2011) starts the warning on low fuel at about 35 miles left, I have run on zero miles left for 20 or 30 miles with no problems. Our local Honda dealer says it is a known problem but no solution, could you help me understand what's going on?

It's designed to protect you from running out of fuel.
