Touareg valve chest problem

I have a Volkswagen Touareg on an 05 plate, which I bought three-months-old from Volkswagen dealer.

All the servicing had been done by VW but the last one was done at my local garage.

There's a downshift problem from fifth to fourth. Apparently it's a valve chest problem, which is known by Volkswagen, they have issued a bulletin.

Volkswagen don't want to foot the bill, or even least part of it, because the car is 5 years old! It is also only 43,860 miles.

Who would expect to change a gear box or part of it when it's covered less than 44K miles? Particularly when the car was such a high price!

Do I have any means to make them pay, given that Volkswagen has issued a bulletin regarding this fault and the car hasn't got a high mileage?

In theory you can make the dealer who sold it to you pay, not VW, under the Supreme Court ruling Clegg v Olle Anderson (trading as Nordic Marine) 2003, or take the car back and refund your money. See: www.honestjohn.co.uk/faq/consumer-rights/
