Who pays for this repair?

I have a 2008 Ford focus 1.6 Zetec petrol, manual gearbox.
Purchased this car in April this year from ford main dealer. car had done 7400 miles.

It has now done 11500.

Just had to get garage to look at a problem when moving gear lever from 2nd to 3rd gear. (Sometimes it will not go into 3rd)
Can you tell me if this is a known problem with this car?
The garage have told me that i will probably have to pay for this to be repaired as they do not think that the extended 3 year RAC warranty I purchased for £499 will cover this problem! They mentioned Baulk Rings, I have no idea what they are.

If the fault is internal to the transmission then this is a 'mechanical breakdown; not 'wear and tear' and any decent warranty would have to pay for the repair. If the warranty does not pay than the warranty that you paid separately for is "not of satisfactory quality". So you can tell the dealer to either fix the car or meet you in court where you will sue the dealer for the cost of the repair. Law here: www.honestjohn.co.uk/faq/consumer-rights/
