Hi folks,

Quick question - if I put a deposit down on a car over the phone, then travel to inspect it / complete the transaction in person, do Distance Selling Regs apply?

I know the car and spec is ok, just having not seen it I don't want to turn up and its covered in stone chips or smells of smoke inside etc.

So could I rightfully claim back my deposit if I got there and am unhappy with it for whatever reason, or does it not apply for small issues and has to be something significant?

Easier to I get confirmation in writing, email will suffice, that the deposit is paid subject to inspection and test drive.

DSR applies if a customer buys or commits to buy a product entirely at a distance, so as you've committed to buy by placing a deposit over the phone, it should apply here (assuming its not a private sale). However there was a similar case in one of the motoring mags recently where legal involvement was required to get the deposit back, so I'd second the idea of getting written confirmation first.

I was told by my Fiat dealer that all deposits given over the phone are subject to DSR.

however your not dealing with M&S here and you might have to go to court, the best tactic is be nice and convince them you will return for another purchase if they are nice to you. Again this wont help if you are dealing with Atilla the backstreet car sales usually of Enfield.
