Help.. drink driving and other offences - _unknown

hi can sum1 help? my stupid waste of space father inlaw got caught drink driving last night, he was arrested and bailed after blowing 135mg. not only that but he was charged with improper insurance, no driving licence he was charged with drink driving about 11 years ago aswell!!! my partner is questioning whether he will go to jail.. any idea if he will have a sentance and if so what that could look like?

With those offences the big stick maywell be administered.

Maximums (rarely imposed)

Drink drive: 6 months impr or £5000 fine or both. Obligatory disqualification.

D Licence: fine £1000, discretionary disq/ 3 - 6 points

Insurance: £5000 fine, discretionary disq/6- 8 points.

One cannot say with any certainty what will be imposed as this will depend on the circumstances outlined, the result of financial enquiry into his means, previous cons and currenlly whether the Mags are taking any heed of the overcrowding of prisons.

Could be 6 months in pokey?

The poster does say 'rarely imposed'. All the same, it does not look good. A second offence and what, 135 mg, that must be getting on for 4 times over the limit. I would enrol on an alcohol rehabilitation course (try APAS) and get some good representation.

Starting point for that level of alcohol is 12 weeks in jail, range is High level community order to 26 weeks custody.
