A well known celebrity chef get's pulled for driving the wrong way up a one way street - fails a breath test.

Further report a day or so later - he's not to be prosecuted due to a police "procedural error".

Excuse me? How does this work? Can we non-celebrities look forward to more "procedural errors" should we be unfortunate enough to require one?

FACT: said Chef being serialised in self same newspaper.

If the machine at the PS records a reading of alcohol in your breath of 40 to 50 micrograms per 100ml then a defendant MUST be given an option of substituting with a blood or urine sample. Plod decides which IIRC.

Metpol didn't do this.

It matters not the fact that you can be completely blotto and legless but if all the i's are not dotted and the t's crossed on the procedure then your not prosecuted.

I think PU will confirm that this bit of legislation has more case law than any other.

Then the Police Surgeon is called in and if he confirms a genuine aversion to the needle then urine sample given under supervision of course. Not a nice job.

Killing time can assist or have an adverse effect.

If you have been tanking it up then there is a chance the readings could be rising.

There again if you had tanked up and rested then the reading could be coming down.

More case-law than you can shake a stick at. In fairmess local Police (non-met) are pretty good on this although the odd case does cause problems for them. I find that most of the time the defendant's version is less convinicing than the Police - I good tell you some right pearlers.
