Hi all,

Parked my car on the High Street in High Wycombe today, as its a Bank Holiday Monday, a lot of people were parking their cars a long the High Street like they do on Sundays. I parked my motor in virtually the same spot as i did the sunday last week, but this time as i came back about 10 mins later, there was the dreaded ticket slapped on my windscreen, gulp!!!!

But the fact is, there were IIRC no warning notices around the area i parked in & none i can see whilst entering the High Street!!!!

Does anybody have any opinions on this??? Cheers

If there is the usual legal sign up with some sort of wording with the restrictions, then I am sure it will not have a space for "Bank Holiday Monday".

All Mondays treated the same.

Do you think i should be let off due to the fact that is a Bank Holiday & that no traders use that particular space, as Monday isnt a market day in Wycombe anyway?!

Didnt see any, there were a few peeps parked in the same area too that got slapped, iv never seen an attendant around there before on a public holiday.

Worth getting hold of the Order for the street in question to see if BHs ae specifically excluded, you will probably find that
Good Friday and Christmas Day are the only ones. Ask yourself (presumably its the council enforcing and not the cops) this, why pay Traffic Wardens double time when the lines are not enforcable ? (I presume they're not that inefficient..)

Appeal regardless. Always appeal. Make the process as difficult, time consuming and expensive for them as possible.

High Wycombe Local Authority has applied for and been granted a Special Parking Area and Controlled Parking Zone for its area.

As a result the responsibility for parking enforcement rests with the LA many of whom sub contract. It also decrimininalises Yellow Line parking offences and non payment of Penalty Charge Notices can results in civil action for debt recovery.

The effect also of a SPACPA means that restriction plates giving details of when not to park are no longer required at intervals but that details will be on the larger plate at the entrance to the SPACA. There is need however to have a plate at any change of restriction - double to single etc.

I have been told that minor discrepancies in relation to signing as shown in Traffic Signs and General Directions are permitted because it is no longer a criminal offence (balance of probability as opposed to beyond any reasonable doubt?)

If you still think you have grounds to appeal then get a letter of to LA asap as there generally is a 50% discount if paid within 14 days and letter of appeal should put this on hold. If they reject then you still have an avenue of appeal to a parking adjudicator and this should be pointed ouit in the LA reply.

I clicked on 'High Street' & 'Cornmarket' which is mentioned on my penalty notice, it mentiones that they have restrictions there 24 hours a day or something like that, its confusing DVD!!!

If you think High Wycombe is confusing come to Southend, you'll soon learn to check every restriction plate and ticket machine wherever you park, even if you've lived in the town for nearly 50 years.

Parking is currently free in Town Centre on Sundays and certain Bank Holidays but is about to change, other days Pay & Display 09:00-18:00, (except for the 4 Thursdays before Xmas when it's 09:00-16:00).
Different tariff for Pay & Display for on road parking to that for off road car parks but machines can be adjacent to an area to which they do not necessarily apply.
Parking on Seafront Pay and Display operates 365 days a year. Some shopping areas Waiting limited to 1 hour no return for 4, others 30 mins no return for 3 hours.
Other roads no parking 24/7 alternate side of road alternate months, others no parking 24/7 April-October, yet others, no parking 24/7 Mar-October.
There are more but you get the picture and just to keep the motorist on his toes they change them about with remarkable regularity. No wonder Southend is in the top ten for issuing tickets.
As you can imagine really makes the shoppers and day trippers feel welcome when they get a nice yellow sticker on their car to take home with them; bargain at only £30.

Not sure appealing makes sense unless you have some grounds - making the system more time consuming and expensive for 'them' (the LA?) is only going to result in those extra costs being passed on to motorists or tax payers again isn't it?

Saw several examples of people with tickets in Bromley yesterday - some had parked on yellows, others in P&D bays, apparently NONE had seen the signage confirming there was NO exception for the bank holiday.

I'd certainly appeal if there is no signage but it's pointless doing so if there is.

In such times send as many awkward letters as possible, and also ask for all information held by them under the Freedom of Information Act (plenty of templates on the net) It will annoy them having to collate it all, and also, you know what they know about you so you can pre-empt any further action based on what they know you did etc...

Soory but I don't buy this 'annoy them' approach. If they're all cynical jobsworths they won't give a damn and in any event all the extra paperwork you generate will just enable them to earn more overtime and/or further justify their existance.

As regards the Freedom of Information Act, they will be entitled to make a charge for providing the information and the last time I checked the relevant quantitative phrase was 'reasonable'. Quite what might constitute a reasonable charge for any information you request is up for debate but it might well start approaching the amount of the fine if you see what I mean.

Yes, 3/4 of what you earn goes back to the state here, where I live, they fine you £1000 for not putting the wheelie bin on your drive after THEY leave it in the middle of the pavement, yet I can't fine them when they forget it or do other things wrong. Councils used to serve the people now they are just setting up ytaps and looking for an oppurtunity to fleece them so they can give money to their beloved scroates, and much of the time, it is the motorist who is the easy target as they are prevalent, have an income, are mobile, easily identified and highly visible.

Being passive only makes matters worse. It means that at relatively low cost any local authority can generate high income just by making sure rules are vague or changed every so often. And it encourages them to replicate the scheme.

There was a programme trailed this morning on BBC tonight about the parking situation in London.

The reporter got a job as a warden after hearing from a whistleblower of how motorists are regularly given tickets because they are unaware of the many differing rules which apply in local authority areas and because the wardens are under pressure to meet targets.

These variations in the rules are I believe going to be regulated by statute this year to try and bring some order into the chaos.

Urgent need to have a Code of Practice on this. LA's deflect flack by sub contracting out to what appears to be nothing more than cheats and charlatans. Should be put out of business for being too zealous.

Well everbody, i actually payed my £30 earlier today, but say if i was to appeal it may end up costing me more in the long run with other fees at the end of the day!!

In future make sure that the yellow lines are on the road according to the layout rules; I don't know where to find chapter and verse on this but I do know that the ends of a pair of double yellow lines have to have a third line at right angles across the ends, closing them off and extending towards or to the edge of the pavement. If they don't do that then they aren't legal or enforceable,SFAIK

I though you might like to know, there were no yellow lines at all on the High Street, just a big sign with the red circle & 'no stopping' thats all!

That'd be the red circle on a white background that means No Vehicles because part of the High Street and all of Corn Market is a pedestrian area according to Bucks CC's website. The website also states that there is no parking in Corn Market 24/7, limited disabled parking in the High Street, some loading bays 9-6 Mon-Fri and no stopping except for buses plus no parking in all other areas 24/7. These all covered by the TRO which set up a Controlled Parking Zone for the centre of High Wycombe.
Sorry, fraserjp, it looks like they've got you bang to rights and that you've just been lucky on Sundays as the TRO seems to operate all restrictions 7 days a week unless the plates state otherwise.

Actually it wouldn't cost you more. When you appeal the "half price if you pay within 14 days" fine counter is reset to 0. If you loose appeal 99% of times you can pay discounted price. If not, appeal to pay discounted price and they won't say no to that. :D
