Hi All,

This is my first post. This is to do with AA Warranty which I think people should be aware of.I bought my car from Cargiant who sold me this 3 Gold Cover Warranty for £700.

My BMW 5 Series now has a few issues ,clutch & flywheel needs to be replaced as well as the Rear brake pad & Disc.

However when notifying Cargiant ,they didnt take an interest and just told me to speak directly to my Warranty company.

Anyway I finally get through to AA Warranty and they have told me they will send one of their engineers to inspect the car before it has any work done to it.The garage is quoting £100 plus.

Much to my surprise AA have stated they won't pay for brake pads,any wear & tear and only pay labour up to £40 an hour .They are yet to confirm if the clutch /flywheel will be covered also. They are yet to send their engineers out so as you can imagine im without a car.Courtesy car isn't covered at level of warranty I purchased I was told.You'd think Gold would be the highest standard.

I was under the impression that the car warranty covers me for the cost of any mechanical and electrical repairs that are needed on my car, including parts and labour.

My associate who also has a BMW(1 series) had his timing chain sorted.He didn't have to pay for the warranty,it came free with the company Lookers.co.uk.They also went to a main dealer,(BMW) and covered all his costs and provided a BMW 3 Series as a courtesy car.

Is it me or am I being ripped off by AA Warranty?Is there anything I can do about my predicament.Ive heard about warranty companies trying to wiggle themselves out of paying.

Cargiant don't seem interested even though they were pressuring me at the time to buy this warranty!

I think its poor showing to missell me a warranty which doesn’t seem to cover a great deal and won't let me use main dealers such as BMW themselves.

Has anyone had similar issues and had any solutions?

I would appreciate any comments or suggestions.

How long ago did you buy the car? Selling you a warranty doesn't absolve Car Giant of all responsibility.

How old is it? That can make a difference to what a reasonable expectation is.

I bought it in Feb 2015.

Cargiant told me to deal directly with the warranty provider.It is a 2012 plate.

May that be a lesson to you. I was told this a while ago : ASSUME - makes an ASS out of U and ME.

As to your case, you don't say how long you've had the car for - which could be very important, as if it's a very recent purchase, then faults would be viewed as pre-existing, and the responsibility of the selling garage to fix, and nothing to do with the warranty.

The devil is in the details, as always.

Generally, none of these third party warranties are worth the paper they're printed on!

However, no warranty, not even a manufacturers one, will cover wear and tear items like brake pads and discs or clutches.

As others have already said, if you haven't had the car very long then it's the responsibility of Car Giant to fix it; this is nothing to do with the warranty and comes under the Sale of Goods Act.

Firstly, no car warranty even a manufacturer all singing all dancing new car warranty will cover wear and tear items like brake pads, discs, tyres, exhausts or belts etc etc so you can't fault them for rejecting the brake claim.

The clutch is again a wear and tear item but the flywheel is another matter. If the flywheel has broken up then this is a failure that should be covered. It's not a wear and tear item. Has it failed though? If the clutch has worn out then often garages will suggest replacing the DMF at the same time. Is it making a rattling noise?

Age and mileage are factors too. What age is the car? What mileage is on it? and how much did it cost you? also how long have you had it?

I agree that most used car warranties aren't worth the money and the massively overinflated £700 price you paid for it is ludicrous. It will have cost the dealer around £100 possibly slightly more! We used to get huge commissions from selling warranties and other insurance backed products but I found it difficult to push something I didn't believe offered value. This was when we offered unlimited claim limit RAC warranties which proved to be excellent and even these were a fraction of what you paid.

So to sum up, the DMF should be covered assuming it has failed. The rest won't.

This was making a rattling noise.Apologies but what is a DMF?

The mileage is 93,877 and I have had since Feb 2015.It is a 2012 plate.

A DMF is part of the clutch assembly - it's there to take the torque 'shock' out, otherwise the huge levels of torque in modern diesel engines would tear apart gearboxes.

Anyway, brake pads and discs, and a clutch assmebly / DMF are viewed as consumables on a car - especially as you've had it for over 2 years.

No way in hell is a warranty company liable for those repairs - they're no different from needing to get tyres replaced when they wear out, you wouldn't expect those costs to be covered by a warranty, would you ?

All warranties exclude normal wear and tear and 93,000 miles could be construed as expected wear and tear on almost any component including a DMF. A warranty on a higher mileage car like this is largely of no value I'm afraid as the firm could wriggle out of almost any claim.

I realise it doesn't help you here but you should read the small print before agreeing to buy any financial product, if you had I don't believe for a second you would've bought this product and to be honest if you had asked on here before buying a high mileage used BMW diesel you would've encountered a lot of negativity and suggestions you look for something else, I would've been one of those voices.

Don't buy a premium executive car unless you can afford to buy a good one, as in a new or nearly new approved used with low mileage and full dealer history. These are expensive cars new and they need dealer or genuine specialist maintenance which is costly. They're not as robust as people believe and expensive problems like this are commonplace. This particular engine is well known for timing chain problems too especially when annual oil changes have been neglected or servicing garages have used the wrong oil. Small backstreet workshops and fast fit chains have a habit of getting this wrong, with an 'it'll do' attitude.

Your policy document would detail exactly what would, or would not, be covered.

A quick search online brought up policy details, exclusions include "Workshop consumables and service / maintenance items which includes, but is not limited to : spark plugs, glow plugs, brake and clutch frictional material, wiper blades and arms, bulbs, batteries and fuses"

If you'd actually read the document, it's pretty clear. The document is not huge and full of confusing legal-speak, it's 2 pages long.

The DMF or 'Dual Mass Flywheel' is the flywheel you mentioned in your first post Vick.
