Hi everyone really hoping I can get some advice on a nightmare situation that has happened today.

My wife took delivery of a brand new Seat Leon on a 3 year lease 3 weeks ago today. This morning when bending down to pick up a toy my daughter dropped on the pavement I noticed a plastic panel hanging down under the rear passenger side area. We took the car to a SEAT garage who put the car on a ramp. It looks like the car has been driven over a bollard or something because there is bad damage to the metalwork under the car, the plastic cover is ripped and only part of it is still attached and hanging down.

This must have happened even at the Dealership prior to hand over to the lease company or by the driver when he drown it down for delivery to us.

We checked round the whole car on delivery and even bent down to look at the wheels etc but never noticed this 3 weeks ago so are not absolutely gutted to find all this damage underneath the car.

So now we don't even know where to start, who to speak to and whether we have any rights?

We've rang the lease company today to tell them everything and they are going to contact the dealer where it came from but surely they won't own up to it even if they caused the damage?

Can anyone at all offer us any advice as we feel sick we've been absolutely stitched up. Thanks anyone that has taken the time to read this.

I'm pretty certain 3 weeks is too late. You (or your wife) could well have caused the damage, and there is no way of proving otherwise.

You might get a sympathetic ear, but I'd doubt it.

If not, then do yourself a favour, and take it into an independent bodyshop to get the work done. Most Dealers use them, and just add a wedge onto the price for their own profit.

I know 100% that I've not hit the bottom of the car. I've only been driving it around town road for 3 weeks. Its only when the car has put on a ramp there is clear damage to the underside of the car where the metal has been ripped and half of the plastic cover is missing. My gut feeling is the plastic panel was bodged up to stay up and has now come lose and is hanging down which is what has caused us to get car put on a ramp and checked.

It's very frustrating as you don't expect to have to have a car lifted up to inspect the underside in detail.

Yes : take it into an independent bodyshop, and get a quote for getting it fixed.

But I've already advised that.

Three weeks is too long. Imagine if you sold a car privately, in good condition, and 3 weeks later the new owners came back, pointed out damage under the car, and insisted it must have been there from before you sold it. You'd tell them to do one, as they were obviously trying it on.

I will point out something else. Your wife took delivery of (I assume) her new car. Yet you've been driving it around town for 3 weeks.

In a lot of cases, you'll find it's the other driver who has caused the damage, and is just too embarrassed/afraid to admit it. So hell, why not say it must have been there from before you got it ?

The problem is that it is effectively your word against theirs, unless you can prove that the situation was not caused by damage from usage (whether by yourselves or those originally delivering it) - your only chance is that an independent inspection states that the 'damage' is caused by fault(s) in the manufacture of the car, which may be difficult given where the problems lie.

I had an issue with my car where the dealer found at service a plate under the car had been half sheared off - I didn't remember scraping anything (I am normally very careful) other than once or twice the front bumper on a high road hump, but I accepted that it was probably me that had caused it as opposed to the servicing agent (no road humps in the area and no other damage to indicate they had had an accident whilst giving the car its short 'test run' at the service. It may be that unless the 'bottoming out' is significant, you may not have noticed it.

Somehow I think you'll find it difficult to prove it was the dealer after the time elapsed - just bad luck you'll unfortunately have to endure and pay for the repairs.

I would certainly challenge the dealer and get to hear what they have to say about the damage. However, don't be at all surprised if they deny all knowledge; as others have rightly said, three weeks is really too long to have let it go and it will probably be your word against theirs.

If that doesn't work you could just, presumably, claim on your insurance. Yes, I know it's wrong and you shouldn't have to do this but, presumably, if it's a lease car then, sooner or later, the car will have to be returned and the cost of repairing the damage would be held against you, so you might as well get it repaired correctly now.

The damage could have been caused when the car was unloaded from the transporter at the dealers. I believe quite a few cars are damaged in this way.
