My daughter has just been involved in an accident ( 100% NOT HER FAULT ) but unfortunately her precious ford ka has been written off. The car was only worth about £400 and the rear end damage was obviously over and above the worthiness of the car.

Her insurance company sent out a recovery team and the vehicle was taken some 25 miles away and because its a write off they are not going to give her a courtesy car, even though they are delaying the write off process by having their engineers have a look at it. My daughter complained that she needs a car for her work, so her insurance company have put her onto a firm called Crusader assist who will try to arrange a hire car for her.

This accident has only just happened 29/04/14. Should we be aware of hire scama here ?

Is her insurance company behaving correctly on this fully comp policy ?

Anyones advices asap would be appreciated.

Comprehensive policies do not give you an automatic right to a loan car, we have to pay extra on our policy. Does your daughter have the automatic right to a car, normally in the case of a right off until the claim is paid out.

Appears to me in this case that your daughter has no automatic right to loan car and Crusader Assist will attempt to claim the monies off the other party, If they are unsuccessful they will then go after your daughter and the sums can be huge.

For a car worth £400 its not worth the risk. Just buy another car or hire one yourself and try and claim the monies from the other party.

Claim the hire car for say 2 /3 weeks until you can get a replacement car from the 3rd party insurer - their driver caused the problems - they should pay to fix your situation - cash for the write-off and hire expenses for a modest car for 2/3 weeks.

It may well be worth contacting the other Insurers directly and asking them to provide a hire car and pay the write off for the car.

This will save them money and take the risk away from the credit hire but more importantly you need to be aware that claiming directly from her own policy will normally mean her insurers will deduct any remaining premium instalments from the settlement they send. Some Insurers will also try can cancel the policy
