Volkswagen Polo IV - Incomplete PDI - meldrew20

I received a new Polo in November 2011. In December 2013, at the second service, I was informed that the transit front suspension blocks had never been removed,(which explained the harsh ride), at the PDI. Up until now, would the car have failed to pass a Road Traffic Act inspection? Was it safe and legal? Was it legally insured?
