Today, Like many other days, I park along a stretch of road, where other cars park, behind my place of work.

Last week, I Spoke to a Civil Enforcement Officer as I was coming to work and double checked with him where I can and cannot park and said where I was currently parked was alright even though I was parked on a raised part of the road, and didn't give me a ticket.

Today, as always, I was parked on said raised road, and got issued a PCN, stating "Parked in a special enforcement area adjacent to a dropped footway."

Please could I get some help as to whether or not I should contest the ticket, as no one else has had a ticket where I was parked in the past and that I have been given wrong information by another "CEO" or a different "CEO" has issued it for no reason.

Would I be correct in assuming that the 'dropped footway' and 'raised part of the road' combine to form an area to be used as a pedestrian crossing - whether 'officially' marked up as such or not ?

The PCN may be legal IF the pavement/dropped kerb area has been legally designated as a 'footway' by the council. It should be noted that there is no requirement for road markings at the point where parking is prohibited.

So, write to the council asking for a copy of the Traffic Order designating as such, and requesting that if said Traffic Order does not exist, your ticket be cancelled.

Hello Chrissie,

If it is a raised part of the road, and level with the footpath, regardless if the footpath has been lowered or the road raised, it is a walkway, it is usual for such equal heights to be in place for people who cannot use kerbs such as thise in wheelchairs.

it does not have to be marked to be legal, you should also know that I watched a documentry on bbc about traffic wardens and they do have targets to meet based on previous ticket numbers issued according to the BBC, I dont know if that still goes on.

I am fairly sure that while a decision is being made on appeal the cost rise for late payment is frozen until a decision is made, but you wold have to get that in writing and not assume, you would also have to check if that is the case, the rules change so often it is difficult to keep track.

I would also not place too much store on what he said at the time, he may just have tried to be charming, sorry I really am not being sexist, Finally sepcialist enforcemnt would suggest it is only a temp measure while some sort of work is being carried out ?
