Hello. I went into a Hyundai garage and asked if they had a particular car. They said they had one in bath but I would need to make a small commitment for them to get the car to where I live. They asked for five hundred pounds. I said I had not even test driven one of these cars and that if I paid a deposit this would not mean I was obliged to buy it. He said no it would be subject to test drive and that they were not that bad. I asked if I should test drive one they had here and he said no we can get this one in. I then said I would want finance and so he did all the credit chequers to see if I was eligible and I was. I signed some paperwork but again said if I sign all this that dos not mean I was definately getting this car. He said not. I then went in to test drive liked the car but it smelt of dog and had a couple of debts and scratched in it. He said he would sort all of that. I said I wasn't sure if I wanted a diesel or petrol as I had been advised that a petrol would suit my needs better. At this point the manager changed his tune and said he had bought the car off of notability especially for me and said that he could not send it back and that he would not be getting me a petrol in to try. This was said in a dishonest way. I told him that I had not been told that he was buying the car nor that I was obliged to buy it. I said I would come back in the next day. We spoke again and my dad said we had to look at another car as we had seen one cheaper with less mileage. He said he would not lose money on this car and said he had bought it from notability and said it was non returnable and said he could not give back my five hundred pounds. I told him this is not what Chris said and that although I liked the car this was not a done deal. Am I tied in and will I lose my five hundred pounds if I pull out?

You are within your rights to demand your money back. Type a dated letter demanding immediate return of your deposit and if he refuses to hand the money over, then give him the letter, and tell him you will be taking legal action for its return plus compensation. Then submit a claim to small claims court. Important, make sure you havent signed a credit agreement, if you have, contact the firm involved immediately and get it cancelled. Time is of the essense in this case as you will have a statutory cooling off period,

I agree with everything brum has said. This is disreputable car dealing and you had not committed to buying it.

Recently I laid a deposit of £500 with an MB dealer. I was unable to proceed and deposit was returned on the day asked for with no quibble. You have been very unfortunate : best wishes for sorting it out, stay resolute.
