Volvo V70 - accident liability - barney100

We were hit today by a van belonging to a large company, windy narrow country road, came round blind corner onto a long sraight section. Transit sized van coming at speed towards us, we stop expecting the van to do the same...no he just smacks straight into us even though he had time to stop. Our car is in a bit of a mess and so is his van...he admitted liability to three of us and the insurance people are on to it. Can he retract the liability admission? also have peolpe from a car in front who will testify that the van nearly did the same to them only they had a layby to escape into. Interestingly the airbags didn't deploy, apparently if a car is stationary they don't go off.

He can retract but that doesn't detract from the fact that you were stationary at the time of the collision.

Why would the airbags go off? Front passengers weren't likely to be catapulted into the dashboard fast enough. Airbags are also dependent on the rate of acceleration/deceleration.

The airbags will help support your story that you were stationary. So you cannot be held liable.

Airbags only go off if the car is moving above a certain speed (8mph-14mph dependrent on deceleration severity and direction/point of impact)

Not so. The SRS system takes information from several accelerometers placed strategically around the car. These measure the acceleration at those points of fit. By comparing the acceleration data from the different sensors the SRS system can determine the direction and severity of the accident and work out the sequence of airbag deployments required (if any) and whether both stages of two stage bags is required. If you are stationary, with ignition on the airbags will go off if you are hit hard enough in a direction that requires them (a side impact being the most obvious).
