This is how the post started, and I have had enough of this sort of thing. You name and shame the dealer, clearly not having bothered to read the naming-and-shaming policy (which is on a permanent thread above), nor stopping to think that accusing a business of lying opens us up to potential legal action for defamation.

As Rob rightly says below, we have only your side of the story. A public forum is not the place to defame a dealership, and I have therefore deleted the whole post. There is good advice below as to what you should do instead.

They have not instructed a barrister. My understanding is that barristers can only take instructions from a solicitor. Try reading the Which guidelines to the new act, in particular these paragraphs:

"If you're past the first 30 days but a problem has become clear which would have been present at the point of purchase, then you're entitled to ask for a repair or replacement free of charge.

But after the first six months, the onus will be on you to prove that the fault was present from the day you purchased the car."

The thing is, we've only got one side of the story, yours.

On the face of it, however, if they are refusing to deal with the problems, then your only choice is Small claims court.

Their 'supposedly' independent barrister is no such thing : he's being paid by them, so it's obvious where his loyalties will lie.

Oh, and get trading standards involved.

BUT : leave out the superfluous information. The fact that you borrowed money from a friend is irrelevant.

You've complained, they have responded.

Your only option now appears to be a 7 day letter before action - plenty of examples on the web, with a subsequent Moneyclaim and possible Court appearance if they don't pay up.
