Should Volkswagen replace my Golf's faulty EGR valves?

I have a 2010 Volkswagen Golf 1.6 diesel DSG and the EGR valves need replacing. Is this something I should try to claim is caused by the emissions problems or am I just unlucky? My car is one of those on the recall list.

If the EGR fails prematurely (within 60k miles) I am telling people to try to claim this as a consequence of the VAG emissions defeat ECU programming. More than 60k, they can get choked anyway an any diesel.
