Our Motability conversion was ordered in the wrong model - how do we get our car delivered to the correct specification?

My mum ordered a car on the Motability scheme. Having waited four months to receive the car, we went to the dealer to pick up the new car which had been registered and taxed, got the keys, went outside and the car was the wrong model - what a sickening blow. After much apologising from the salesman, we were told there was nothing we could do but accept the car or wait until November of this year when a new car could be received.

After we explained the fault lay with the salesman and the company, and that they should rectify the matter, the manager then informed us that there was nothing they could do except apologise, which I felt was not acceptable. Not much sympathy. The best they could do was let her keep the old car. I asked if it was possible to compromise and we would accept £250 goodwill gesture, considering that hiring another similar car was going to cost Mum a lot more money. They said they would do this, so we left the dealership with a new delivery date of November.

Yesterday the branch phoned to say they have another car in the same model as the original one ordered. I was a bit suspicious as to how this had come about, as we had been quoted November for delivery. I was told someone had ordered the car and then changed their mind. I smell a rat. They then asked if I could do them a favour and tell the DVLA that I didn't want the car, as they have to deregister the other car. I am trying to explain to mum that they want her to lie about the car, but the thing I am most worried about is the legality of telling lies. Could you advise me of things I can ask the dealer?

The garage is trying to find a way to accommodate you within a complex set of rules, so either you go with this or you have to wait until November. As long as no laws are broken, go for it.
