Car Parking Penalty

I recently parked in a car park on a Sunday; the ticket machine was out of order and no other machine was available. On return there was a parking ticket on my car AND a parking ticket envelope on the machine saying "out of order, go upstairs to other meter."

I challenged this saying I owed the council for three hours parking and would pay this amount. My challenge was rejected as "there was no evidence that the meter was not working." I had failed to use other means of paying, such as by ‘phone. Should I pay the fine?

Refuse to pay and let the matter go to the small claims track of the county court claiming negligence and entrapment by the car park operator.
