Can you clarify whether parking enforcement on private land is a civil matter?

I am somewhat confused by the advice you gave to RJ of Stockport in November ('Space Invader'). You stated that the owner of the land was quite entitled to charge a penalty if the terms of the parking agreement were breached, as long as these terms were clearly displayed in the car park. I thought that your view was that parking on private land was a civil matter, and any amount claimed by the owner had to be 'proportionate' to the loss incurred. Also, that private companies rarely, if ever, sought to prove their case in court. It would be helpful if you could clarify the matter.
