Windscreen scratches - does the dealer repair?

I have just bought a Nissan Note - test drive seemed OK.

Driving home from dealer the sun was in my eyes and I noticed a lot of scratches on the windscreen that were not visible before. I told dealer immediately, as soon as I got home. His response was "well it has an MOT."

I believe the sum total of the scratches, which can be felt with thumbnail, would mean it would fail an MOT. Should the dealer be responsible for replacing the windscreen?

This vehicle is 3.5 years old with 13,850 miles on the clock and cost just under£6000.
