volvo v40 1.8i 52 plate 97k - water hose perished- new engine required - unlucky or not

My volvo broke down rapidly on the motoerway last night with no warning. Water was pouring from the water hose underneath which was hanging down with a perished jubilee clip. I purchased the car from a dealer 4 months ago and he said he had given it a "lub" service" as stamped in the book. Should he have looked at this hose and as the engine is damaged so much, new gasket, pistons etc, do i have any legal recourse?
