My 2007 Ford Mondeo has an air conditioning fault that was apparent when I bought it. What can I do?

I purchased a Ford Direct Mondeo 1.8 TDCI on 9 March 2009 (with 12,800 miles). During April, when the weather got warmer, I ascertained the air conditioning was not working. On 29 April I arranged for the dealer to check the air conditioning (at 14,000 miles). It needed re-gassing but they could not find a leak, and it was all done free of charge. It was OK all summer. On 12 April this year it was apparent the air conditioning had stopped working again. It was re-gassed, but this time a dye was added as once again a leak could not be found.

The air conditioning again stopped working this August and I advised the dealer I wanted the matter resolved at the same time as a service. The dealer found the leak and told me a stone had caused it in the radiator, and this was not covered by the warranty. The cost for repair was over £300. I maintain that the air conditioning had a leak when I purchased the car. The Ford Direct helpline advised me it was recommended that the air conditioning should be re-gassed every 12 months. Can I have your opinion?

It is possible that the stone damage occurred before you bought the car, and if you had made this allegation within six months of purchasing the car the dealer would have had to roll over. As it is, the burden of proving that the fault pre-existed your purchase rests with you, and you can't prove it. See: www.honestjohn.co.uk/faq/consumer-rights
