Should Nissan fix my rusty Pathfinder for free?

I own a 2006 Nissan Pathfinder and I have noticed quite a bit of rust around the tailgate handle. I have been told that Nissan are aware of the problem and have modified the handle. However, my local dealer says this is a paint defect and will not repair under the 12 year body warranty. Can you confirm if the handle has been modified and if the work can be done under warranty?

If the tailgate has rusted through and if you have conformed with the terms of the Nissan 12 year body warranty (which probably involved annual inspections) then you should be covered. If all that has happened is that paint has flakes off then that would only be covered by the three year paint warranty.
