Had accident, but guilty party won’t pay – what should we do?

My wife was recently involved in a road accident, which wasn’t her fault. The other party accepted liability at the scene and offered £800 to fix the car. However, after speaking to a mechanic, we found that the repairs would cost a lot more than £800.

We have spoken to the other party and been told they will not pay more than £800, because it exceeds the value of our car. We have agreed to take the money, but weeks have passed and we’ve received nothing. Can we decline the money and go through her insurance company?

Simply sue her using www.moneyclaim.gov.uk for the cost of replacing your car (which you must prove by privately advertised prices), plus your losses for any hospital treatment.

Warn her and her solicitor first that you will be taking the matter to court if she does not settle. And make sure you inform your insurer with full details.
