Ford S-MAX warning light with no fault?

The engine malfunction light comes on every time I switch on the ignition in my Ford S-MAX. I have taken the car to a Ford dealership twice who have run diagnostics and can find no fault code?

They reset it but within a day the light comes on again. They say that instrument panel needs download BUT they have had problems with this and could mean new instrument cluster at approx £800, which I would have to pay for as an upgrade can scramble it.

Can you advise 1. Can I still drive car safely? 2. If new instrument cluster needed do I have to pay for it or should the garage?

Might be nothing more than the battery having lost some capacity. Worth asking the dealer to try a new battery.
