Who's at fault

I was involved in a shunt last week in a motorway services car park. I believe the other driver to be at fault and they appeared to agree at the scene, however now that I have contacted the insurance companies they are claiming 50/50 liability.

I took photographs of the damage to both cars at the scene. I believe these photographs clearly show that the side of my car was hit by the rear of the other car. I expected this would prove the liability was with the other driver, as I reasoned it was impossible for me to drive my car sideways into their car.

Now I find my insurance company are refusing to use the photographs as evidence to prove liability in the accident. I am trying to contact the service station about possible CCTV camera footage, but dont recall seeing any cameras. I am obviously very upset by this and would like any advice on how to solve this problem.

They can't be bothered. But it doesn't make any difference with an insurer who can't be bothered anyway. The claim will go against your record and your premium will go up next year as a result. Take account of this when buying your next insurance.
