My car was stolen but my insurer won't pay out because I didn't declare penalty points?

I recently had my car stolen. I had received 6 penalty points a couple of months previously and did not realise I had to tell the insurance company. They have said they will not pay my claim because of this. Is this legal?

Unfortunately the insurance company are within their rights to not pay out on your claim. The specific terms and conditions of your policy will explain how your insurance company operates and it may be that their policy insists you notify them immediately if you receive a driving endorsement. Some insurance companies do not need to be immediately notified, but if you are renewing your insurance with an existing provider or getting a new policy elsewhere, you are required by law to notify them of any driving endorsements. It is worth contacting the Financial Ombudsman who may be able to assist.
