Nothing new?

I am in dispute with Nissan in Basingstoke because they sold my wife a Micra on the basis of no model changes inside a year from the date of purchase, and she signed the purchase order 4 days after the new Micra was launched. They say that there was no material misrepresentation because it does not represent a model change. The model is not being changed; it is being completely replaced. I am going to take them to Court but I am receiving conflicting information on which I would much appreciate your views. If you are buying an end of range model how much do you think the original purchase price should be discounted by and after you have bought an end of the range model by how more does the car devalue after the new model comes out or even before it. I do not want to take up too much of your time but I would be happy to write the thing up for you once it has been settled if it is of interest.

I don't think you have a case because the new March/Micra is completely different car from the old UK Micra and will not be in the at least UK until November. The fact it is already in production in Thailand is irrelevant because those cars are Thai, not UK spec. Different suspension. Different tyres. Different trim. They don't even have heaters. On the date you wrote (12th May) the factory in Chennai, India, that will produce the new Micra for the UK had not yet built a single car. Not even pilot production, though that will start soon. However, you should have negotiated some sort of discount on the Micra you bought.
