Half braked

My 4 year-old Fiat Punto with 14k miles on the clock was recently put through the MOT test and failed. I was contacted by the garage (Arnold Clarke, Newcastle under Lyme) and advised that it required new brake discs and pads to pass the MOT. As time was short I authorised the work costing £175 but asked them to retain the old parts for inspection. On collecting my car I looked at the parts and did not agree with the fail result of the test. The parts were not in a bad condition. The garage offered to speak to the MOT inspector and seek his advice. They later called me to say that the inspector also did not agree with their failure of my car. He recommended that it should have passed with an advisory note that the discs were pitted. The garage has offered me a 50% refund on the £175, but my argument is that I should be entitled to a full refund, as it was their error that caused the problem. As a pensioner I can't afford excessive expenditure. I paid the garage £100 for a service and MOT test, plus £175 or the discs and brake pads. I would really value your considered opinion on this matter.

You would be entitled to have the old discs put back free of charge, which would be pointless and bloody-minded. Or you are entitled to the cost of the wear left in the old discs, which the garage has offered to pay. You are not entitled to new discs for nothing. £100 for a service is rock bottom. And £175 for the discs and pads was very reasonable. £87.50 for new discs and pads is more than reasonable.
