I sold my car to sell car uk Internet buying site BMW x3 2005 I was told get £6000 I live in Scotland person came up from Nottingham check everything was told by person on phone to take for a test drive for 10 minutes he did phoned back told them everything ok I was then offered '£5500i said £5600 was agreed this was on 18 sept he drove it down to Nottingham six days later they phoned up and said there was a mechanical fault with car I would have to pay £1700 to put right as they said I must have known about it I refused telling them I was not a mechanic and did not know was anything wrong with car and they had test driven it they said well pay us £1000 I said no now.they say they are taken me to court keep emailing and phoning me all day and up to 11.00 at night could any one please help and tell me if they can do this they are telling me I have to take the car back and they want £1500 excess from me when they start there case they say they are returning car to me which I say I am not willing to take back would be very grateful for any help.

If you are a genuine private seller the buyer has no claim on you whatsoever
Warn them the next time they call you will take the matter to the police as harassment is a criminal offence.

Hi ,
This is nonsense on the part of the company that bought your car ,they have no hope of recovering any money from you in any court .
The Internet buying company would be considered professional car dealers in this dispute ,it's for them to determine what condition the car is in before they complete the purchase .
As a private seller you're not considered in law to have sufficient knowledge to advise a professional dealer as to a cars condition .They inspected the car and test drove it .If their is a genuine fault it's their mistake and problem .
It's far more likely that they are trying to extort money from you , usually companies like these hope that you will offer a reduced amount as a compromise .Dont do it .
Regrettably their is little that you can do to stop them ringing you ,even threats of police involvement will not stop them .
Can I suggest that you simply put the phone down when they ring you ,alternatively if you have the numbers of the people who are ringing you ,ring them late at night say 2 am ,and first thing in a morning at 6am .
It won't stop them ringing you , but having done it myself in the past ,it's satisfying to know you're a nuisance to them .

As tony says, if you can be bothered (and you have their number), give them a few anonymous calls when they are in bed.........otherwise just put the 'phone down without commenting if they call again.
