Claim against dealer - they hbave now closed - Med

Hi, i hope this would be a quick one for you lot...

I am currently in a legal battle with the selling dealer of my car for over 2 years now. I have just received a letter from the manufacturer that states that dealership is now closed in the sales point of view but is only open for servicing and parts, no-one would tell me if the ownership is the same though.

Can i continue my claim against them for mis-selling me the car if they are no longer in sales and if the management has changed for what ever reason and/or they close completely then does my case refer to the manufacturer?

Hi again Med, obviously you have not yet gained satisfaction in your quest, sorry to hear this.

Whilst I am sure your barristor would be the best (& most expensive) person to answer your question, the answer depends upon the legal status of the actual business that sold you the car.

For example if ABC Motors Ltd sold you the car & these have now ceased trading then you can no longer pursue them, if however ABC Motors Ltd trading as ABC Car Sales sold you the car & simply the car sales aspect of the business has ceased to trade then you can still pursue ABC Motors Ltd

Or was it a sole trader rather than a Ltd company? eg Albert Brian Carruthers trading as ABC Car Sales? If so then you actually bought the car from an individual, so you can always go after him.

Clearly Mazda UK have nothing to gain by helping you to claim against one of their dealers by way of suplying you with info, so it's down to you to do some digging.

The management of the company has no relevence, it is the company you are claiming against.

As has been previously stated, you have no claim against Mazda UK

You need to find out more about the legal basis of the company-just because they don't SELL cars any more doesn't mean that your claim is dead.

If they are a limited company you can check up on them for free here:-

Including accounts back to 2002 and search for directors details and addresses.
