I brought my car 3 months ago. Last week it went for it's MOT and it failed. I have been told that someone has removed the instrument cluster and messed around behind it to hide the fact that the ABS doesn't work. Renault have ordered me a new cluster and are going to fit it this week but that may not solve the original ABS problem but will show what the problem is. I brought my car from a private garage and the cost of the works to be done is £52 less than the price I paid for the car - do I have any right to go to the garage and ask for some money? Any advice would be greatly appriciated. Thanks

I would give the private garage a ring first where you bought the car from.

The difficulty is proven who removed the instrument cluster.Did you recieve a warranty with the car,if you did there might be some help.Some legal or independent advice maybe.

Perhaps a bit more specific information is needed before a definitive answer can be given. One of the crucial bits is the way the car was described either by way of the advertisement, in your discussion with the garage and was any kind of warranty given. These after-sale faults are always tricky to resolve but if this is something that one would expect any specialist trader, i.e. the garage that sold you the car, would have known about even though they may not have actually fiddled with the instrument cluster, then you could have recourse. Perhaps a second opinion from a friendly third-party expert who could say whether this fault would be obvious to the seller might be helpful. Not nice thinking you might have been duped by an unscrupulous trader but do get a technical opinion, go back to the garage to see what they say and if you get a negative response you have to make a decision whether you have sufficient evidence to support your claim for compensation through the small claims process. By the sound of it they have removed the warning bulb for the abs my guess is you will find the main abs unit is faulty I do not think anyone would go to the extend of removing the dash if it was only a sensor or ring fault.

The selling dealer does have some potential liability but that diminishes with the age of the car. The other consideration is whether the repair is "proportionate" - it is arguable wehther spending the full worth of the car to replace the dashboard when that wil not fix the fault is proportionate.

don't think we have established why the car failed the MOT. A list of reasons would be useful.

If we can establish that some of those problems were likely to have been there at the time he sold the car you may well have a case to get them rectified.
