Bought a 520diesel 2008 plate car out of the showrooms and we asked if it was the new 2008 engine with the 177 bhp and the sales manager confirmed this but now we have ad it for 3months we have found out that it is a 2007 163 bhp we have been intouch with him and he said he would replace it at first now after calling and calling him he as told us that when a part exchange comes in we can have that but argument is when and if it's the right car for us which we thought we had bought for £19300 from main dealer can anybody tell us were we stand and what can we do. How did you find out what engine you had? According to the info below, the 163bhp engine was introduced in 09/2009 while the 177bhp engine was introduced in 03/2007.

Having a BMW 5 series and knowing a little about them myself the above info provided by Andy P is spot on.Are you sure you have all the facts correct.

What does it say in the log book,

Take the car id number to BMW and they will be able to provide a full build spec which will include the engine size and power output.

Check the logbook - the Co2 ratings are different and that should tell you which you have. The older engine has 158 or 185g/km (manual or auto) and the other 136 or 149.

The 177bhp came out in September 07 and if it's an 08-plate can only be a very late registered 163bhp as most were gone by early 2008.

From a legal point of view you don't say when you bought it.

That said if the circumtsances were not as you say it is not "as described" and hence the Sale of Goods Act potentially comes into play.

work out what you want. if you dont want the car ask for a refund

if actually the cars fine, then ask for a bit of money back, work out the difference in residual values between the 2 specs when you plan to sell as a guide

they may well not want to shell out cash, so then maybe suggest some free servicing etc

in the end dont let it take over your life!!
